Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the BreathFree application and its associated services (collectively, the “Service”), operated by BreathFee LTD, registered in the Netherlands, with its registered address at Teststreet 12, 2222TT Amsterdam, the Netherlands (“we”, “us”, or “our”). By creating an account or subscribing to BreathFree, you agree to these Terms in full.

1. About BreathFree

BreathFree is a digital wellness subscription app designed to support users in quitting smoking over a 21-day guided programme. The Service is provided for informational and motivational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.

2. Eligibility

You must be at least 18 years old to subscribe to and use the Service. By accepting these Terms, you confirm that you meet this requirement. The Service is intended for personal, non-commercial use only.

3. Account Registration

To use BreathFree you must create an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at info@rolandb31.com if you suspect any unauthorised use.

4. Subscription, Billing & Auto-Renewal

4.1 Subscription Plans

BreathFree is offered on a recurring subscription basis. Available plans, prices, and billing intervals are displayed on our website and in-app at the time of purchase. All prices are inclusive of any applicable Dutch VAT (BTW) unless stated otherwise.

4.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period for the same duration and at the then-current price, unless you cancel before the renewal date. You will receive a reminder before any renewal where required by applicable law.

4.3 Payment Processing

Payments are processed by third-party payment providers (see our Privacy Policy for details). By subscribing, you authorise us to charge your chosen payment method on a recurring basis. If a payment fails, we may suspend access to the Service until the outstanding amount is settled.

4.4 Price Changes

We may change subscription prices from time to time. We will give you at least 30 days’ advance notice of any price increase by email. Continued use of the Service after the new price takes effect constitutes your acceptance of the new price.

5. Cooling-Off Period (Herroepingsrecht)

As a consumer purchasing a digital subscription in the Netherlands, you have the right to withdraw from the contract within 14 calendar days of the date your subscription begins (“cooling-off period”) without giving any reason, in accordance with the Dutch Civil Code (Burgerlijk Wetboek, Book 6) and the Consumer Rights Directive (2011/83/EU) as implemented in Dutch law.

However, if you expressly request that we begin providing the digital Service immediately during the cooling-off period and you acknowledge that you waive your right of withdrawal once the Service is fully performed, your right of withdrawal may be forfeited upon commencement of the Service. We will ask for this acknowledgement at checkout. If you have not waived this right, you may exercise your right of withdrawal by contacting us at info@rolandb31.com before the 14-day period expires.

6. Cancellation

You may cancel your subscription at any time. To cancel, you can: (a) use the account settings within the BreathFree app; or (b) send an email to info@rolandb31.com. Cancellation will take effect at the end of your current paid billing period. You will retain access to the Service until the end of that period. Please refer to our Refund & Cancellation Policy for details on refund eligibility.

All content within BreathFree, including but not limited to text, graphics, audio, video, software, and programme materials, is owned by or licensed to BreathFee LTD and is protected by Dutch and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal purposes only during your active subscription.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available”. While we strive to deliver a high-quality experience, we do not guarantee that the Service will be uninterrupted, error-free, or that results (such as quitting smoking) will be achieved. The programme supports behaviour change but individual results may vary.

10. Limitation of Liability

To the maximum extent permitted by Dutch law, BreathFee LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the three months preceding the claim. Nothing in these Terms limits liability for death, personal injury caused by our negligence, or fraud.

11. Modifications to the Service or Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree, you may cancel your subscription before the changes take effect.

12. Termination

We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands, unless mandatory consumer protection law grants you the right to bring proceedings in another jurisdiction. You also have the right to submit disputes to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
